✅ Acceptance of Terms

By accessing or using the sumermetal.shop website, submitting inquiry forms, placing orders, or engaging with any of our services, you confirm that:

• You are at least 18 years of age or have reached the age of majority in your jurisdiction
• You have the legal authority to enter into binding contracts in your capacity as an individual or on behalf of a business entity
• You have read, understood, and agree to be bound by these Terms and Conditions in their entirety
• You agree to comply with all applicable local, state, national, and international laws and regulations

Sumer Metal provides the following services:

• Supply and distribution of metal products including steel, aluminum, stainless steel, copper, and specialty alloys
• Custom metal fabrication, cutting, and processing services as agreed upon in writing
• Structural steel supply for construction and infrastructure projects
• Surface treatment, finishing, and coating services
• Technical advisory services for material selection and specification
• Bulk supply and contract-based delivery arrangements

All products are subject to availability. Sumer Metal reserves the right to modify, suspend, or discontinue any product or service at any time without prior notice. Product descriptions, specifications, and images on our website are provided for informational purposes and may vary from actual products.

We make reasonable efforts to ensure the accuracy of product information, but do not warrant that all descriptions are complete, accurate, current, or error-free. Specifications are subject to change without notice due to manufacturing updates or material availability.

📦 Orders, Pricing & Payment

Order Placement: All orders are subject to acceptance by Sumer Metal. We reserve the right to decline or cancel any order at our discretion, including in cases of pricing errors, product unavailability, or concerns regarding the order's legitimacy.

Pricing:

• All prices quoted are in Indian Rupees (INR) unless otherwise stated
• Prices are subject to change without notice due to market fluctuations in metal commodity prices
• Quotations provided via email or phone are valid for the period specified therein, typically 24–72 hours
• Final pricing may include applicable GST, transportation charges, and handling fees as specified in the invoice
• Volume discounts and special pricing arrangements must be confirmed in writing by an authorized representative

Payment Terms:

• Standard payment terms are advance payment unless a credit account has been established
• Accepted payment methods include bank transfer (NEFT/RTGS/IMPS), UPI, and cheque for registered clients
• Credit terms, where extended, must be agreed upon in writing before the first order on credit
• Late payments may be subject to interest charges at 2% per month on the outstanding amount
• All prices are exclusive of GST unless explicitly stated otherwise

🚚 Delivery & Logistics

Delivery timelines are estimates and are subject to stock availability, transport conditions, and other factors beyond our control. Sumer Metal is not liable for delays caused by carrier issues, natural disasters, government restrictions, or force majeure events.

• Standard delivery across Bengaluru: 1–3 business days for in-stock items
• Outstation deliveries: 3–7 business days depending on destination and freight availability
• Custom-cut or fabricated items: delivery timeline as confirmed at time of order
• Risk of loss or damage transfers to the buyer upon delivery to the specified address
• Customers must inspect all deliveries at the time of receipt and report discrepancies within 24 hours
• Delivery charges are determined based on order weight, dimensions, and delivery location

🔄 Returns, Refunds & Cancellations

Returns Policy: Sumer Metal accepts returns only for the following reasons:

• Product does not match the agreed specification or purchase order
• Defective material confirmed by quality inspection and mill certificate verification
• Wrong items delivered as compared to the invoice
• Damage sustained during transit that was not pre-existing at point of sale

Returns must be initiated within 7 days of delivery. Returned goods must be in original, unused condition with all original documentation. Custom-cut, processed, or fabricated items are non-returnable unless defective.

Refund Process: Approved refunds will be processed within 10–15 business days via the original payment method. Sumer Metal reserves the right to offer credit against future orders in lieu of cash refunds for certain cases.

Order Cancellation: Orders may be cancelled before dispatch without penalty. For cancellations after dispatch or for custom orders already in process, cancellation fees may apply as per the terms agreed at time of order.

All content on the sumermetal.shop website, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is the property of Sumer Metal or its content suppliers and is protected by applicable intellectual property laws.

• Unauthorized use of any trademarks, service marks, or logos is strictly prohibited
• You may not reproduce, distribute, modify, or create derivative works from our content without explicit written permission

⚖️ Limitation of Liability

• Damages caused by delays in delivery beyond our reasonable control

Our total liability in any matter arising out of these Terms shall not exceed the invoice value of the specific products or services that gave rise to the claim. This limitation applies regardless of the form of action (contract, tort, or otherwise).

By providing your contact details or checking the consent box on our contact form, you expressly consent to receive communications from Sumer Metal and/or My Inbox Media ® via the following channels:

• SMS — transactional and promotional text messages to your registered mobile number
• Email — order updates, newsletters, product information, and promotional offers

🛡️ Warranties & Disclaimers

Sumer Metal warrants that all products supplied conform to the specifications agreed upon in the purchase order or quotation. Where mill test certificates are provided, they represent the product's material composition and mechanical properties as certified by the manufacturer.

However, we disclaim all other warranties, express or implied, to the fullest extent permitted by law, including:

• Implied warranties of merchantability or fitness for a particular purpose beyond stated specifications
• Warranties regarding the suitability of materials for specific engineering applications not assessed by our team
• Warranties regarding the accuracy of third-party technical information or standards referenced in product descriptions

The website is provided on an "as is" and "as available" basis. We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.

🏛️ Governing Law & Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any legal proceedings arising out of or related to these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India. By using our services, you consent to the personal jurisdiction of these courts.

These Terms constitute the entire agreement between you and Sumer Metal with respect to the subject matter hereof and supersede all prior or contemporaneous communications, whether oral or written.

🤝 Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your use of our products and services, we encourage the following resolution process:

• Step 1 – Informal Resolution: Contact our team at info@sumermetal.shop. We will make every reasonable effort to resolve the issue informally within 15 business days
• Step 2 – Mediation: If informal resolution fails, both parties agree to attempt resolution through a mutually agreed-upon mediator in Bengaluru before resorting to formal legal proceedings
• Step 3 – Litigation: If mediation is unsuccessful, disputes shall be resolved through the courts of Bengaluru, Karnataka, India as specified in Section 11

🚫 Termination & Suspension

Sumer Metal reserves the right to terminate or suspend access to our website and services, with or without notice, for any reason including:

• Breach of these Terms and Conditions
• Fraudulent, abusive, or illegal activity
• Non-payment of dues beyond agreed credit terms
• Circumstances where continued service would expose us to legal or reputational risk

Upon termination, all provisions of these Terms which by their nature should survive termination shall remain in effect, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
